FORT WAYNE, Ind. (WFFT) — Authorities say an Allen County man pleaded guilty Wednesday to engaging in sexual contact with a sleeping woman while on a full airplane nearly four years ago.
According to the FBI in Indianapolis 39-year-old Ian Wagner, of New Haven pleaded guilty to one count of abusive sexual contact while he was on a Frontier Airlines flight from Indianapolis to Denver, Colorado on Oct. 6, 2017.
Wagner was seated next to an 18-year-old woman.
During the flight, the woman fell asleep and later awoke to Wagner rubbing her inner thigh with his hand as he was masturbating.
After moving her body away, the victim took a picture of Wagner using her phone, according to the FBI field office in Indianapolis.
According to the phone's location, the FBI says the incident happened while the plane was over the state of Nebraska.
The woman then left her seat, and went to the restroom in order to get away from Wagner, but eventually returned because she believed the flight was full and no other seats would be available.
After going back to her seat, court documents state that she saw that Wagner had placed a jacket over his lap and was again masturbating.
Wagner made eye contact with the victim and lifted his jacket to reveal his exposed penis.
For over five minutes, Wagner masturbated while staring at the victim, according to the FBI.
Two days later, the victim filed a complaint with the airline and with police in the following weeks.
He is scheduled to be sentenced on Dec. 15 by a federal district court judge and faces a maximum of three years in prison.
Wagner will be required to register as a sex offender.
The FBI’s Indianapolis Division Joint Terrorism Task Force is investigating the case.
